Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and Parish Center LLC ("Parish Center," "we," "us," or "our") governing your access to and use of the Parish Center web application, mobile application, and all related services (collectively, the "Services") available at parishcenter.net.

BY ACCESSING OR USING OUR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT ACCESS OR USE OUR SERVICES.

1. Eligibility

You must be at least 13 years of age to create an account or use our Services. If you are under the age of 18, you represent that you have the consent of a parent or legal guardian to use our Services.

2. Account Registration and Security

To use certain features of our Services, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

3. Acceptable Use

You agree not to use our Services to violate any applicable law; infringe third-party rights; transmit unlawful, harmful, or abusive material; distribute unsolicited commercial messages (spam); attempt unauthorized access; interfere with Service integrity; harvest personal information without consent; impersonate any person or entity; or use automated means to access the Services without our prior written consent.

4. SMS/Text Message Program Terms

Parish Center offers an SMS/text messaging program that enables parishes and their communities to communicate via text message. By opting in to receive SMS messages from Parish Center, you agree to the following terms:

4.1 Program Description

The Parish Center SMS program provides parish community communications, event notifications, group updates, ministry announcements, and other informational messages from your parish community. Messages are sent by Parish Center on behalf of participating parishes.

4.2 Opt-In and Consent

You may opt in to receive SMS messages by: (a) enabling SMS communications in your Parish Center account settings; (b) texting a JOIN keyword to our designated phone number; or (c) providing your phone number and affirmatively consenting on the public opt-in page at https://www.parishcenter.net/sms-opt-in. Consent to receive SMS messages is not a condition of purchase, registration, or use of our Services.

4.3 Message Frequency

Message frequency varies depending on parish activity and your communication preferences. You may receive recurring messages. The number of messages you receive depends on the communications sent by your parish and the groups or ministries you are subscribed to.

4.4 Message and Data Rates

Standard message and data rates may apply to all SMS messages sent and received, depending on your mobile carrier and service plan. Parish Center is not responsible for any fees charged by your mobile carrier.

4.5 Opt-Out

You may opt out of SMS messages at any time by replying STOP to any message you receive from us. After you send STOP, you will receive a one-time confirmation message confirming that you have been unsubscribed. You may also opt out by disabling SMS communications in your Parish Center account settings.

4.6 Help

For help with our SMS program, reply HELP to any message or contact us at support@parishcenter.net.

4.7 Supported Carriers

Our SMS program is supported on all major U.S. carriers. Carriers are not liable for delayed or undelivered messages. T-Mobile is not liable for delayed or undelivered messages.

4.8 SMS Data Privacy

Your mobile phone number and SMS opt-in data will not be sold to or shared with third parties or affiliates for their own marketing or promotional purposes. Information collected through the SMS program is subject to our Privacy Policy.

5. Donations and Giving

Parish Center facilitates donations and giving on behalf of participating parishes. All donations are processed by third-party payment processors. Parish Center does not store full payment card numbers.

6. Intellectual Property

The Services, including all content, features, functionality, software, text, graphics, logos, trademarks, and the "Parish Center" name and logo, are owned by Parish Center LLC and are protected by United States and international intellectual property laws.

7. User Content

You retain ownership of any content you submit through our Services ("User Content"). By submitting User Content, you grant Parish Center a non-exclusive, worldwide, royalty-free, sublicensable license to use, host, store, reproduce, and display your User Content solely for the purpose of operating and providing our Services.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PARISH CENTER LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES.

10. Indemnification

You agree to indemnify, defend, and hold harmless Parish Center LLC from any claims, liabilities, damages, losses, costs, and expenses arising from your use of the Services or your violation of these Terms.

11. Termination

We may suspend or terminate your access to the Services at any time, with or without cause and with or without notice.

12. Dispute Resolution and Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. CLASS ACTION WAIVER: You agree that any Dispute shall be resolved on an individual basis and not as a class action.

13. General Provisions

• Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Ohio.
• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Parish Center.
• Severability: If any provision is unenforceable, the remaining provisions shall remain in effect.
• Notices: Notices to us should be sent to support@parishcenter.net.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website with a new "Last Updated" date.
